nextGen Professional of the Year Award 2023

Our annual award recognises excellence in turnaround and restructuring in the UK with less than 10 years industry service.

Criteria

This award is for those currently working in turnaround and restructuring in the UK who demonstrate exceptional performance and career development with less than 10 years’ industry service (the majority of which should have been spent in the UK market). The Judges will be looking for evidence of:

• service and achievements that both go beyond the call of duty, and exceed that expected of someone with less than 10 years’ experience;

• contributions which work towards improving good working practices in the industry;

• particular cases which showed innovation and commitment and resulted in benefit for the firm and / or clients; and

• a tangible commitment to the turnaround and restructuring industry beyond that undertaken in their normal working day

*TMA NextGen, the next generation of UK Turnaround Professionals, is tailored to those in the early stages of their career aged 40 and under.

Johnny is a PwC trained, ICAEW Fellow Chartered Accountant and Managing Director of J9 Advisory. He has over 20 years of experience specialising in Business Recovery Services and Asset Based Lending within some of the UKs most respected organisations including PricewaterhouseCoopers LLP, Barclays Commercial Bank, Santander Bank and Begbies Traynor Group. Paul Davies USE
Paul Davies

Paul Davies is a Business Restructuring and Insolvency Partner at James Cowper Kreston, who has a particularly focus on turnaround and restructuring and is President of the Turnaround Management Association UK from 1 January 2021. Paul has operated in restructuring and insolvency for over 20 years and his role incorporates debt advisory (particularly the alternative finance market), accelerated M&A, Board advisory, business reviews and stakeholder negotiations. Paul has recently worked in a number of sectors including food, hotels and leisure, construction and logistics. He was named Turnaround Professional of the Year at the 2017 TRI Awards. Paul is also a qualified insolvency practitioner and is licensed by the ICAEW to accept formal insolvency appointments in the UK.

Philip Povey USE
Philip Povey

Philip’s practice focuses on complex cross-border and domestic special situations mandates. He works for a range of restructuring stakeholders across the capital structure in distressed contexts – including corporates / directors, private equity sponsors, distressed investors, financial institutions / alternative credit providers, trustees / agents and insolvency practitioners. Philip has considerable experience advising in connection with cram-down processes (including schemes of arrangement, restructuring plans and CVAs), restructurings of public bond debt, work-out negotiations, liability management transactions and formal insolvency / enforcement.

Mandates include:

  • Advised the boards of directors of the three UK DeepOcean entities (as well as certain directors of the Dutch Parent company, DeepOcean Group Holding BV) that entered into only the third sanctioned Restructuring Plan in the UK – this market-leading deal involved the first use of the cross-class cramdown provisions in the Companies Act 2006.
  • Acting for a key minority sponsor in connection with the restructuring of the Pizza Express Group, in particular its negotiations with the board and the group’s bondholders pending sanction of only the second Restructuring Plan in the UK.
  • Lead associate for a consortium of creditors and investors in NCP Car Parks (including the strategic challenge to the car park operator’s Restructuring Plan).
  • Acted for Reliance Communications of India on the cross-border restructuring of its public bond debt, reaching an acceptable compromise with bondholders under an English law bond.
  • Lead associate in connection with supporting a well-known private equity house in relation to its non-standard debt investment structure in a distressed portfolio company.
  • Led an asset-based refinancing of a portfolio company for a leading mid-market private equity house.

Philip was elected by peers to be President of TMA NextGen London. TMA NextGen represents all stakeholders engaged in the turnaround space below the level of Partner. Philip had previously been serving as Vice-President.
