For our June event we welcome Richard Tett - Freshfields as our guest speaker for the evening.
Richard Tett will give a presentation on important developments around Europe. This will focus on the developments with the Recast European Insolvency Regulation and what changes this has brought. Richard will then focus on the new proposed Dutch scheme of arrangement – which may be a real contender to overtake the popularity of the English scheme, once it comes into force and settles down. Richard’s talk will also touch on Brexit and how this affects restructuring and turnaround professionals, as a teaser for a panel session to follow. Lastly, Richard’s talk will cover the proposed EU directive for a pre insolvency restructuring regime and how this might change the insolvency framework in Europe – and in the UK.
The talk will then lead into a panel session where Richard is joined by senior associate Lee Rogerson - Freshfields, Stuart Mathieson - Barings and Stephanie McMahon - Deloitte to discuss how Brexit is shaping the restructuring and turnaround framework.
Such animated exchange of views can then continue over drinks and canapes.
About the speaker/s
Richard is a finance partner and heads the Freshfields Bruckhaus Deringer London international Restructuring & Insolvency Team.
He has 20 years of restructuring experience and has worked extensively on ‘in court’ and ‘out of court’ restructurings/refinancings, intercreditor agreement disputes, formal insolvency appointments, high yield bond and CMBS bond restructurings, distressed M&A, English schemes of arrangement, US Chapter 11s and s363 sales, pension deficits, insurance workouts, telecoms, and insolvency aspects of structured finance.
Richard has acted across the capital structure for all the key stakeholders including corporates, lenders, bondholder/lender formal and ad hoc committees, creditors, shareholders, private equity sponsors, distressed debt investors and asset purchasers, directors, security trustees, administrators and liquidators.
Stuart Mathieson is a member of Barings’ European High Yield Investments Group and the European High Yield Investment Committee. Stuart also leads the Global Special Situations Investments Group, where he is also responsible for representing the firm’s interests on restructurings and workouts, and managing high yield portfolios.
Stuart has worked in the industry since 1999 and his experience has encompassed the sub-investment grade credit markets. Prior to joining the firm in 2002, he worked in the Business Recovery Services team in London at PricewaterhouseCoopers. Stuart holds a B.Sc. in Chemistry from Keble College, Oxford and is a member of the Institute of Chartered Accountants, England & Wales.
Lee is a senior associate in the restructuring and insolvency team.
He has experience acting for creditors, debtors, distressed investors, administrators, receivers and other key parties in the restructuring and insolvency market on complex restructurings and insolvency mandates.
Lee has worked on a wide range of cross-border restructurings, refinancings, distressed M&A and pensions restructurings, including through schemes of arrangement, security enforcements, administrations, company voluntary arrangements and arrangements with the UK Pensions Regulator.
During his time at Freshfields, Lee has been seconded to the firm’s Beijing office for six months and spent nine months on secondment at Barings.
Stephanie is a partner in Deloitte’s restructuring practice. She has 20 years restructuring experience advising corporates, lenders and shareholders in both the public and private sector – primarily focused on the more complex, larger restructuring projects. Her experience ranges from debt restructuring to strategic advisory and distressed M&A across a wide range of sectors including retail, pharma, waste, construction and TMT.
