Our restructuring and insolvency practice covers the full spectrum of the distressed curve, acting for companies, boards, secured and unsecured creditors and insolvency practitioners. Our team of dedicated specialists provide the highest levels of technical excellence, commercial acumen and pragmatism to lenders, international creditors, and professional and SME boards, and insolvency practitioners considering strategy in distressed scenarios and mitigating risk for counterparty failure. We advise creditors how best to maximise their recoveries in a distressed or insolvency scenario and work with insolvency practitioners to effect sales of businesses and assets in time-pressured environments to maximise realisation into the insolvent estate and minimise exposure of the insolvency practitioner. We often work closely with other practice areas when doing so, in particular our leading regulatory, tax, data protection and sanctions teams.

A key part of our practice is the turnaround of distressed situations. In particular, our expertise in bringing and defending claims particular to insolvency legislation, as well as misfeasance and breach of duty actions, give us an edge when mitigating those risks through those challenging scenarios. We assist companies dealing with secured and unsecured creditors and other stakeholders including pension trustees, and advise on the use of insolvency and other enforcement procedures. We counsel on risk and responsibilities and frequently advise boards of directors on their personal risk and how to mitigate it. Our work frequently involves cross-border insolvency, and we have litigated insolvency cases to the Supreme Court in England and Wales, as well as managing cross-border teams in onshore and offshore jurisdictions.
